AMPUTATIONS
Occupational amputations, or similar injuries that result in the functional loss of use of an organ or appendage, can be one of the most devastating industrial injuries. It can be cold comfort to the claimant, but there is a specific form of compensation designed to provide relief for a claimant for the obvious economic hard suffered when an amputation occurs.
Scheduled loss compensation can be paid to claimants who sustain an amputation in the course and scope of their employment, or who sustain an injury in the course of their employment that results in the functional loss of use of an appendage or organ. The value of this compensation is oftentimes determined by the exact appendage or organ that the claimant has lost the use of, or the point of amputation at designated by the attending physician. Additionally, multiple amputations can sometimes equate to a larger award if functionally speaking, the amputations prohibit a return to work at your former position of employment/professional trade.
If you have sustained an amputation in the course of your employment, or an injury you feel inhibits your ability to use an appendage, or to see clearly, or to hear anything at all, please seek the advice of qualified counsel to determine your potential eligibility for scheduled loss compensation. The Bureau of Workers’ Compensation and self-insured employers alike will very frequently underpay awards based off of a conservative interpretation of the schedule which expresses the applicable rates of payment. You cannot be certain that you are receiving the entire amount of compensation you may be entitled under the law until you speak with qualified counsel.
